Recentemente approvata in Italia, la Direttiva Omnibus è volta ad adeguare l’impianto normativo comunitario all’evoluzione digitale dei mercati online, garantendo così maggiore trasparenza e tutela verso il consumatore. In merito a tale adeguamento, è importante fare una precisazione: il nostro Codice del Consumo prevedeva già delle regole in tema di pratiche commerciali scorrette (ingannevoli o aggressive), e le norme che disciplinano tali pratiche commerciali restano valide, semplicemente si integrano con le novità previste dal recepimento della direttiva.
Infatti, l’obiettivo è sempre stato quello di tutelare il consumatore, che è il soggetto centrale presente nel nostro ordinamento. In questa prospettiva, la Direttiva Omnibus mira a inserire riferimenti più precisi e disciplinare aspetti finora lasciati scoperti per una maggiore tutela del consumatore.
Quali novità introduce?
Le novità introdotte dalla Direttiva Omnibus sottolineate nel corso del Webinar comprendono, in particolare:
- gli annunci di riduzione di prezzo;
- nuove fattispecie di pratiche e omissioni ingannevoli;
- disciplina delle recensioni e il loro corretto utilizzo a fini promozionali;
- Novità in tema di contratti conclusi a distanza;
- Nuovo regime sanzionatorio.
Infatti, procedendo in ordine, la nuova direttiva prevede che i nuovi annunci debbano riportare il prezzo precedente applicato dal professionista per un determinato periodo di tempo prima dell’applicazione di tale riduzione, tenendo conto che per prezzo precedente si fa riferimento al prezzo più basso applicato dallo stesso professionista nei 30 giorni precedenti. Tale direttiva si applica in ottica B2C, ed è entrata in vigore dallo scorso 1 luglio.
Inoltre, sono oggetto della direttiva tutti gli annunci di riduzione di prezzo che possano fare pensare ai consumatori che il prezzo di un determinato prodotto sia diminuito rispetto a quello precedentemente applicato; tale specifica si applica solo ai beni e non ai servizi, alle vendite straordinarie, e non alle vendite sottocosto.
A tale aspetto si aggiungono le pratiche commerciali ingannevoli, con particolare riferimento alle ricerche online, per esempio fornire risultati di ricerca al consumatore senza indicare che si tratti di un annuncio pubblicitario a pagamento. Emblematico, in tale senso, è il caso delle recensioni, e il possibile utilizzo ingannevole a opera del professionista di recensioni o apprezzamenti falsi, così come l’utilizzo di false informazioni su tali prodotti allo scopo di promuoverli. Secondo la direttiva, le recensioni pubblicate devono provenire da consumatori che hanno effettivamente acquistato e utilizzato il prodotto.
Infine, per quanto riguarda i contratti conclusi a distanza e negoziati fuori dai locali, il consumatore deve avere chiaro quali sono le condizioni del contratto che va a sottoscrivere nell’eCommerce, dal recesso, alla restituzione, fino ai costi di spedizione. Il professionista deve quindi fornire, oltre a quanto già previsto, l’indirizzo geografico dov’è stabilito, il numero di telefono, recapito email, e indirizzo e identità di terzi qualora il professionista agisca per conto di terzi.

In sintesi, la direttiva Omnibus ha un impatto significativo sulla pubblicità, sull’eCommerce e sul rapporto con i consumatori. Regolamentando l’annuncio di riduzione dei prezzi e le recensioni dei consumatori, tale direttiva mira a garantire una maggiore trasparenza e a proteggere i consumatori dalle pratiche commerciali ingannevoli.
